These Terms of Service govern your use of Where is the picture?, accessible at whereisthepicture.com.
Where is the picture? is a web application that analyzes photographs to determine or estimate the geographic location where they were taken, using EXIF GPS metadata and/or AI-powered image analysis (Google Gemini).
Some features (AI-based analysis for photos without GPS data) require credits. Credits are sold in packs via Payhip, our payment processor. Payments are processed securely by Payhip; we do not store your card details.
Credits are non-transferable and tied to the browser session in which they were purchased. Unused credits do not expire but may be lost if browser storage is cleared.
Due to the digital and immediately consumable nature of the service, credits are non-refundable once used. If you have purchased credits but have not used them, contact us within 14 days at frankzen@gmail.com to request a refund.
You agree not to upload images that are illegal, infringe third-party rights, or contain sensitive personal data of third parties without their consent. You are solely responsible for the content you upload.
Uploaded images are processed in memory and are not permanently stored on our servers. See our Privacy Policy for details.
The service is provided "as is" without any warranty. AI-based location estimates may be inaccurate. We do not guarantee the accuracy, completeness, or fitness for any particular purpose of the results.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.
